Submission of an enquiry, proposal, business opportunity, transaction structure, funding request, commodity proposal or other communication to Al’s Creek does not create any obligation on Al’s Creek to review, pursue, respond to or accept the opportunity.

Nothing in this section prevents Al’s Creek from seeking urgent or equitable relief in any court of competent jurisdiction to protect its intellectual property, confidential information, systems or other legitimate interests.
Any dispute arising from a separate client engagement, commodity transaction, funding arrangement, investment transaction, advisory mandate or other commercial agreement shall be governed by the dispute-resolution provisions contained in that separate agreement.
27. SEVERABILITY
If any provision of these Terms is determined by a competent authority to be invalid, unlawful or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect.
28. NO WAIVER
Failure by Al’s Creek to enforce any provision of these Terms shall not constitute a waiver of its right to enforce that provision or any other provision in the future.
29. ASSIGNMENT
You may not assign or transfer your rights or obligations under these Terms without the prior written consent of Al’s Creek.
Al’s Creek may assign or transfer its rights and obligations under these Terms in connection with a merger, restructuring, sale, reorganization, transfer of assets or other corporate transaction, subject to applicable law.
30. ENTIRE AGREEMENT
